Minimum requirements

What are the minimum requirements for:

  • Application for probate
  • Letters of administration
  • Letters of administration with the will
  • Reseals

Application for probate

You will need to provide the following documents for an application for probate.

You may need to provide additional information in some circumstances. ** Means merge as one document.

Application: Form 100 – Probate title (UCPR) + Form 101** - Application for probate (UCPR)

Original will and two clear photocopies of the original last will (one copy to be attached to the Affidavit below)

Affidavit in support: Form 100 – Probate title (UCPR) + Form 105** - Affidavit (UCPR)

Exhibits: a clear photocopy of the original last will and original death certificate + exhibit clause on Form 47 – Certificate of exhibit (UCPR)

Affidavit of publication and service: Form 100 – Probate title (UCPR) + Form 104** - Affidavit (UCPR)

Exhibit: Form 103 - Notice of intention to apply for grant (UCPR) + exhibit clause on Form 47 – Certificate of exhibit (UCPR).

Letters of administration (without the will - Intestacy)

You will need to provide the following documents for an application for letters of administration.

You may need to provide additional information in some circumstances. ** Means merge as one document.

Application: Form 100 – Probate title (UCPR) + Form 102** - Application for letters (UCPR)

Affidavit in support: Form 100 – Probate title (UCPR) + Form 109** - Affidavit (UCPR)

Exhibit: original death certificate + exhibit clause on Form 47 - Certificate of exhibit (UCPR).

Affidavit of publication and service: Form 100 – Probate title (UCPR) + Form 104** - Affidavit (UCPR)

Exhibit: Form 103 - Notice of intention to apply for grant (UCPR) + exhibit clause on Form 47 – Certificate of exhibit (UCPR).

Letters of administration (with the will)

You will need to provide the following documents for an application for letters of administration with the will.

Application: Form 100 – Probate title (UCPR) + Form 101** - Application for probate (UCPR)

Original will and two clear photocopies of the original last will (one copy to be attached to the Affidavit below)

Affidavit in support: Form 100 – Probate title (UCPR) + Form 106**

Exhibits: a clear photocopy of the original last will and original death certificate + exhibit clause on Form 47 – Certificate of exhibit (UCPR)

Affidavit of publication and service: Form 100 – Probate title (UCPR) + Form 104** - Affidavit (UCPR)

Exhibit: Form 103 - Notice of intention to apply for grant (UCPR) + exhibit clause on Form 47 – Certificate of exhibit (UCPR).

Reseals

You will need to provide the following documents for an application for reseals (under the British Probates Act 1898).

The original grant or an exemplification or office copy which bears the rubber, embossed or other seal of the court that made the grant.

Application: Form 100 – Probate title (UCPR) + Form 112** - Application of reseal (UCPR)

Affidavit in support: Form 100 – Probate title (UCPR) + Form 113** - Affidavit

Exhibits: if not the grantee, power of attorney may be required + exhibit clause on Form 47 – Certificate of exhibit (UCPR).

If debts are outstanding in Queensland you will need to:

  • advertise in the appropriate newspaper
  • file Form 100 – Probate title (UCPR) + Form 104** - Affidavit (UCPR).
