Eleven new Planning and Environment Court practice directions and associated industry seminar
The Chief Judge has issued 11 new Practice Directions for the Planning and Environment Court in the interests of the just and expeditious conduct of proceedings in Brisbane.
Although the Practice Directions will not have effect until 18 March 2024, because of their substance, the judges of the Court in Brisbane have conducted a seminar to introduce the documents to practitioners and expert witnesses.
The new Practice Directions include:
- 2023/01 - Repeal, Replacement and Transitional Arrangements for Practice Directions
- 2023/02 - Early resolution or determination of appeals about an infrastructure charges or development approval conditions
- 2023/03 - Determination of merits appeals
- 2023/04 - Determination of originating applications seeking declarations about development approvals and applications
- 2023/05 - Determination of proceedings involving enforcement notices and enforcement orders
- 2023/06 - Listing for hearing
- 2023/07 - Written submissions
- 2023/08 - Reviews, applications and orders on the papers
- 2023/09 - Power of ADR Registrar to make orders and list a proceeding for review
- 2023/10 - Participation of referral agencies
- 2023/11 - Self-represented litigants
