Applying for a Brisbane Supreme Court criminal listing

fsdfdsLawyers can apply online to the Brisbane Supreme Court to change the date of a current criminal listing (move it forward or back) or request a new listing for a matter with a current listing.

You can only apply if all parties are legally represented and agree on the listing sought.

This page explains what you can apply for, how to apply, and what happens after you submit your application.

What you can apply for online

You can apply online for:

AdjournmentTo delay a court date (e.g. mention, hearing, trial, or sentencing).
Pre-trial hearingFor requests like bail or suppression orders.
Sentence listingFor short pleas, lengthy pleas, or contested sentences.
Trial listingTo request a trial date for a criminal matter.

Before you apply

Before applying online, make sure:

  • you have consent from the other party or parties (prosecution or defence)
  • you’ve prepared any supporting documentation needed for the application.

How to apply online

1. Fill out the relevant form (as per Practice Direction 5 of 2024):

2. Email the Criminal Resolution Registrar supporting documentation, such as:

  • medical certificates (e.g. for adjournments due to health reasons)
  • affidavits or statutory declarations.

3. Complete draft orders, if required (as per Practice Direction 5 of 2024)

4. Submit the form online before 1pm on the last business day before the current listing.

What happens after you apply

After you submit your online application, the Criminal Resolution Registrar or criminal list manager (and sometimes the criminal list judge) will review and action it. There are three possible outcomes:

Application grantedYou’ll get an email confirming the new court event, date, or order.

A successful application will result in either an administrative listing (by the relevant registrar or manager) or an order in chambers (by the criminal list judge).
Application refusedYou’ll get an email advising of the refusal. You must attend court as listed.
No response receivedIf you don't get an email, you must attend court on the original date.

When you can’t apply online

You can’t apply online if:

  • you  (or any other party) are self-represented
  • you want the matter adjourned to a different courthouse.

What to do instead

If you’re not eligible to apply online (or have technical issues), email the Brisbane Supreme Court registry all the details and supporting documentation, with a cc to the Criminal Resolution Registrar and SC Criminal List Manager.

This helps the court schedule dates based on the availability of parties, witnesses, and other factors.
