If you were involved in a criminal matter in a Queensland Magistrates Court, you may be able to apply for a:
- rehearing—if your case was heard without you or your representative present (ex parte)
- reopening—if you believe there was a mistake in the facts or law in a case already decided by a magistrate.
This page explains how to apply, depending on whether your case was heard in Brisbane or another Magistrate Court.
How to apply
For Brisbane Magistrates Court cases
If your case was heard at the Brisbane Magistrates Court:
Complete and submit the online application form
Explain why you believe a rehearing or reopening is needed.
For other Magistrates Court cases
If your case was heard at another Magistrates Court:
- Download the application form (PDF, 78.3 KB).
- Fill out the form, including your reasons for the application.
- Lodge the form with the clerk of the Magistrates Court where the original order was made.

What happens next
A magistrate will review your application and court file. This process can take up to two weeks.
You’ll be notified of the outcome by email or post.
If your application is approved, you may need to attend a court hearing or mention. You will be notified if a new date is set.
If you don’t hear back within two weeks, contact the court registry for an update.
