Land Court resources and legislation

This section provides guidelines, resources and procedural directions for the general management of cases in the Land Court of Queensland.

Model directions

The Model Directions (PDF, 509.6 KB) document sets out the preferred format for case management directions made by the Land Court at directions hearings or reviews.

These directions cover key steps before a hearing, such as:

  • identifying issues,
  • sharing information (disclosure),
  • using alternative dispute resolution (ADR), and
  • managing expert evidence.

The document also includes a glossary to help people who may not be familiar with court processes.

When proposing directions for a case, the Court expects parties to use the Model Directions. You can change or add to these, depending on the specific needs of the case.

The Court updates the Model Directions from time to time.

The forms below must be filed 5 days before any hearing review in the Land Court:

Reserved judgments policy

This policy shows how the Land Court deals with reserved judgments. It also explains how parties or their representatives can check the progress of a judgment. The President keeps track of all reserved judgments.

  1. Members of the Land Court aim to deliver judgments within three months of reserving them.
  2. Judgments are reserved on the last day of the hearing. If a party is allowed to provide written submissions, the judgment is reserved when the last submission is received.
  3. If a Member asks for more written submissions after the hearing, the reserve date remains unchanged.
  4. If the Member knows the judgment will take longer than three months, they should tell the parties when it is likely to be delivered.
  5. After three months, a party or their representative can ask about the progress of a reserved judgment. They can send a letter or email to the Registrar. The Registrar will inform the President without sharing who made the enquiry.
  6. The President will respond in writing through the Registrar after discussing the matter with the Member involved.
  7. If the case is public, anyone can ask the Registrar or the President for updates on a reserved judgment. It doesn't matter whether they are involved or not. This includes details such as the reservation date, the judgment, and the Member in charge.

Jurisdiction
