Warrant of redirection of earnings

Supreme and District Courts - Civil

This warrant authorises a third party (usually the employer) to redirect part of an enforcement debtor’s earnings to the enforcement creditor.

The court will issue this warrant after considering if:

  • the debtor is employed, and the employer’s identity and address
  • the debtor earns a sufficient amount to pay the warrant on top of living expenses and other liabilities
  • the amount to be redirected imposes unreasonable hardship.

The creditor should supply a transcript of the enforcement hearing along with a statement of the debtor’s financial position to assist the registrar.

If an enforcement hearing has not been held, the registrar may order:

  • a debtor’s hearing
  • the employer to supply a signed statement detailing the debtor’s earnings.
