Volunteers in the court - Civil
Self-represented Litigants Service (SRLS) staff can:
- explain and answer questions about how the court operates
- give information about court rules, procedures and practices
- provide information about court protocols and etiquette
- explain basic legal concepts and terms
- direct litigants to required forms and relevant legislation
- explain the mandatory requirements for the completion of forms and other court documents
- provide court lists and information about listing cases before the court
- refer litigants to agencies that provide legal advice such as the Queensland Public Interest Law Clearing House (QPILCH), Legal Aid, local solicitors and law firms.
Self-represented Litigants Service (SRLS)staff cannot:
- give legal advice
- tell a litigant whether or not they should bring their case to court, or its likelihood of success
- advise what action a litigant should take in their case
- fill out court forms or paperwork for a litigant. However, staff can check that court documents have been completed correctly e.g. signatures, dates, hearing details, correct file number etc.
- tell a litigant what to say in court
- give an opinion about what will happen in court or the likely outcomes
- talk to a judge or registrar on behalf of a litigant
- accompany a litigant to hearings, trials and other court appearances
- serve papers for a litigant
- assist with Magistrates Court inquiries.
