Minor Debt Claims

Magistrates Court - civil

The Magistrates Court can issue a minor debt claim against a defendant if:

• they owe the plaintiff $7500 or less and
• it is for a fixed or agreed sum of money.

Examples of a minor debt include:

• an unpaid invoice or account
• rent arrears
• work done and/or goods supplied at the request of the defendant
• money loaned and not repaid
• wages owing
• an IOU
• dishonoured cheques.
