Claim and statement of claim
A claim and statement of claim can be used to start proceedings for amounts from $50,000 to $250,000 in the District Court, and an unlimited amount in the Supreme Court. As the plaintiff you can initiate court action by filing a claim and statement of claim at the court registry. The claim can be for an agreed or fixed amount of money, or it can be for unspecified amounts including:
- damages
- breach of contract
- other remedies.
While the statement of claim outlines fully the plaintiff’s case against the defendant, the claim is a brief summary of the statement.
