Warrant of redirection of earnings

This warrant authorises a third party (usually the employer) to redirect part of an enforcement debtor’s earnings to the enforcement creditor.The court will issue this warrant after considering if:
- the debtor is employed, and the employer’s identity and address
- the debtor earns a sufficient amount to pay the warrant on top of living expenses and other liabilities
- the amount to be redirected imposes unreasonable hardship.
The creditor should supply a transcript of the enforcement hearing along with a statement of the debtor’s financial position to assist the registrar.
If an enforcement hearing has not been held, the registrar may order:
- a debtor’s hearing
- the employer to supply a signed statement detailing the debtor’s earnings.
