Who has been declared a vexatious litigant?
The registrar of the Supreme Court maintains a list of vexatious litigants which may also be searched during registry office hours.
Who applies to the court for a vexatious proceedings order?
In the Vexatious Proceedings Act 2005 there is a list of people who can apply to the court including:
- the Attorney-General
- the Crown Solicitor
- the registrar of the court
- a person against whom another person has instituted or conducted a vexatious proceeding
- a person who has a sufficient interest in the matter
What document is filed to declare someone is a vexatious litigant?
An order is made under the Vexatious Proceedings Act 2005 and is published in the Queensland Government Gazette.
Can you appeal against being registered as a vexatious litigant?
Yes. You can appeal to the Court of Appeal.
