Steps to follow
Magistrates Court - Domestic and family violence

Make the decision to get protection and seek legal advice or support. |

Complete a DV1 - Protection order application and lodge it at your nearest Magistrates Court. |

At the court, sign the declaration. The court will give you a copy of your application and will schedule a court appearance date. |

The court will provide police with a copy of the application, and will serve the respondent with a summons to attend court. |

If the respondent attends the first court date, the magistrate will ask if they agree to the order being made. If they consent, a final protection order will be made, usually for a period of two years. |

If the respondent contests the order being made, the magistrate will adjourn the application for a future hearing date and may make a temporary order. |

If this happens, you will need to bring along any evidence or witnesses to support your application on the hearing date. |

If the respondent does not attend the first court date, and the application has been served, the Magistrate can make a final Domestic Violence Protection Order. |
| 9 | Remember, if the situation is urgent and you need help, call the police immediately on ‘000.’ |
